New Jersey Real Estate Buyers Agency Representation Agreement some info:
WHAT IS A BUYERS AGENT:
AS A BUYER’S AGENT, I, AS LICENSEE, REPRESENT THE BUYER AND ALL MATERIAL INFORMATION SUPPLIED TO ME BY THE SELLER WILL BE TOLD TO THE BUYER.
A buyer's agent WORKS ONLY FOR THE BUYER. A buyer's agent has fiduciary duties to the buyer which include reasonable care, undivided loyalty, confidentiality and full disclosure. However, in dealing with sellers a Buyer's Agent must act honestly. In a deal with both parties, a buyer's agent may not make any misrepresentations on matters material to the transaction, such as the buyers financial ability to pay, and must disclose defects of a material nature affecting the physical condition to the property which a reasonable inspection by the licensee would disclose.
A buyer wishing to be represented by a buyer's agent is advised to enter into a separate written buyer agency contract with the brokerage firm which is to work as their agent.

A few more NJ Real Estate buyer agent facts

  • As of August 2024 it will be a NEW & mandatory law for real estate home buyers to sign Exclusive Buyer Agency Agreements with a Real Estate Agent / Broker 

  • Real Estate commissions in New Jersey are (and have always been) negotiable

  • In most real estate transactions the commission is paid by the HOME SELLER 

  • There are different options for compensation to your Buyers Agent: 1: The compensation from seller includes co-op compensation to buyer broker. 2: Buyer Broker compensation is negotiated with the contract/offer to seller, to be paid by Seller. 3: Buyer Broker is compensated by the home buyer at closing. 4: Buyer Broker is compensated by the home buyer via a seller concession in order to include compensation in the sale price. 

  • Home buyer can opt to only view properties where the Seller is offering compensation to Buyer Agents - We still recommend seeing ALL PROPERTIES, ask us why!!

  • There is a scenario where the agreed upon compensation is LESS than what the Seller is offering to Buyer Brokers where a credit for that difference is awarded the HOME BUYER (depending on how different Buyer agents structure their agreements - I will offer this possibility). 

  • It will always be my sincere intention to represent MY BUYER clients without it costing them a single dollar.
